1. The Promoter
1.1 This campaign promotor of this campaign is Abbott Laboratories Limited, a company registered in England and Wales with company registration number 329102 and registered office address at Abbott House, Vanwall Business Park, Vanwall Road, Maidenhead, Berkshire, SL6 4XE ("Abbott").
2. The Campaign and Eligibility
2.1 The title of the campaign is "Ireland: Self-funded Sampling Campaign".
2.2 Eligible individuals can receive one (1) free of charge FreeStyle Libre 2 Sensor in accordance with these terms and conditions
2.3 The campaign is open to:
(a) people with diabetes aged 18 years or over who reside in Ireland. Under 18s cannot participate in this campaign. This campaign is also open to parents/guardians of children with diabetes under the age of 18 and over the age of four;
(b) people who have not used or trialed the FreeStyle Libre system or the FreeStyle Libre 2 system;
(c) people who are not eligible to receive the FreeStyle Libre 2 Sensor on prescription; and
(d) people who have a mobile device compatible with the FreeStyle LibreLink app. Please check the device compatibility guide, which can be found here:
2.4 In entering this campaign, you confirm that you are eligible to claim one (1) free of charge FreeStyle Libre 2 Sensor. Abbott may require you to provide proof that you are eligible to enter the campaign as well as proof of identity as a way to prohibit fraudulent activity.
2.5 Abbott will not accept any entries that do not comply with the eligibility criteria or where you have previously entered or received FreeStyle Libre 2 Sensor. Abbott reserves all rights to disqualify your entry if your conduct is contrary to the spirit or intention of the campaign.
2.6 Prior to entering, you should ensure that you have read and understood the purposes for which the FreeStyle Libre 2 System should be used. This information is available on the FreeStyle Libre website.
2.7 There is a limit of one (1) entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
2.8 By participating in the campaign, you understand that you will receive educational and marketing emails that will include information to help you correctly use the FreeStyle Libre system and that you can unsubscribe from these at any time.
3. How to Enter
3.1 The campaign will open from 00.01am on 19th February 2023 (“Opening Date”). Abbott will notify users on its website of any closing date, but Abbott reserve the right to withdraw this campaign immediately at any time. Entries which are made prior to the Opening Date will not be eligible to participate in the campaign.
3.2 In order to receive one (1) free of charge FreeStyle Libre 2 Sensor, please complete the details set out in the Application Form: FreeStyle Libre 2 Sampling page.
3.3 You acknowledge and agree that the delivery details, including the name, shipping address and telephone number, cannot be altered or modified after submitting the Application Form, therefore, please ensure the details on the Application Form are correct before submission.
3.4 Once the Application Form is submitted, Abbott will check your details against Abbott’s existing databases in line with the Privacy Policy to confirm that you are a new customer. If you pass the eligibility check [BHK1] as set out in paragraph 2.3 above, Abbott will deliver one (1) FreeStyle Libre 2 Sensor free of charge.
3.5 No purchase is necessary and there is no charge to register for use of the website or for postage and packaging of the free sample.
3.6 Abbott accepts no responsibility for Application Forms that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.7 By submitting an Application Form, you are agreeing to be bound by these terms and conditions.
3.8 You confirm that if you are eligible for one (1) free of charge FreeStyle Libre 2 Sensor, it shall not be sold, billed, traded, charged or subject to any claim for reimbursement to any individual or company for a monetary or any other value.
3.9 There will be no cash alternative or prize alternative, other than as set out in paragraph 3.10.
3.11 Abbott is not liable for any disruption to this campaign for reasons beyond Abbott’s reasonable control. In the event of any disruption to this campaign, Abbott will use its reasonable endeavours to resolve the disruption and resume the campaign in a manner that is fair to the participants.
3.12 Abbott reserves the right to delay the timing of notification.
3.13 By entering the campaign, you agree to be bound by these terms and conditions. Any entries not complying with these terms and conditions may at Abbott’s discretion, acting reasonably, be deemed invalid and disqualified
4. Limitation on Amount of Entries
4.1 In participating in the campaign, you acknowledge that:
(a) the campaign is only open to eligible individuals listed under paragraph 2.3; and;
(b) each eligible individual is only entitled to submit one (1) entry and/or Application Form for this campaign.
4.2 It is strictly forbidden to create multiple accounts and/or to submit more than one (1) Application Form and/or to enter, or attempt to enter the campaign more than once (whether by providing your details, another person's details, fake details or otherwise).
4.3 By submitting an entry, you undertake to be an eligible individual (listed in paragraph 2.3), and confirm that you understand any multiple applications and/or Application Forms submitted will be treated as a fraudulent activity and that Abbott reserves the right to report any suspected fraudulent activity to the law enforcement authorities and take legal action.
4.4 If and where Abbott suspects that an individual has submitted more than one (1) entry and/or Application Form, Abbott shall, without prejudice to its other rights or remedies, reserve the right to withhold the relevant prize at its discretion.
5. Data Privacy
5.1 You agree that your personal data supplied during the course of this campaign may be passed on to third party suppliers solely for the purpose of this campaign. Please see our privacy policy if you have any questions.
6. Fraudulent Activity
6.1 You represent and warrant that you have checked the details on the Application Form and can confirm that these are correct.
6.2 Abbott reserves the right to report any suspected fraudulent activity, including but not limited to unauthorised multiple purchases, counterfeit information, or identity theft, to the law enforcement authorities and take legal action as deemed necessary to protect Abbott's interests.
6.3 In the event of a breach of the terms of this campaign, Abbott may impose penalties or seek damages including, without limitation any cost of postage.
7. Sale and Distribution
7.1 You undertake not to resell and/or distribute the FreeStyle Libre 2 Sensor without the explicit written consent of Abbott. Any unauthorised resale shall be considered a breach of these terms. Should you resell and/or distribute the FreeStyle Libre 2 Sensor then Abbott reserve the right to claim from you the then current recommended retail price of the FreeStyle Libre 2 Sensor as a debt.
8. General
8.1 Insofar as is permitted by law, Abbott, its agents or distributors will not in any circumstances be responsible or liable to compensate or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Abbott, its agents or distributors or that of their employees. Your statutory rights are not affected.
8.2 If there is any reason to believe that there has been a breach of these terms and conditions, Abbott may, at its sole discretion, reserve the right to exclude you from participating in the campaign.
8.3 Abbott may disqualify any entrant who it reasonably believes has interfered with or attempted to interfere with the fair running of this campaign.
8.4 Abbott reserves the right to hold void, cancel, suspend, or amend the campaign where it becomes necessary to do so.
8.5 This campaign is governed by the laws of Ireland and Without prejudice to your right to bring proceedings in the country where you reside, users submit to the non-exclusive jurisdiction of the courts of Ireland.
